Construction Lien Act Review: Still not released

On July 25, ECAO, together with other two other executive members of Prompt Payment Ontario and the president of COCA, met with Dave Phillips, the new chief of staff for new Attorney General Yasir Naqvi. The message again was simple: “Release the Construction Lien Act Review report as authorized by Bruce Reynolds and Sharon Vogel by Aug. 15.” At the time, Phillips, together with senior policy advisor Delia Greco, assured us the releasing the report is a priority for the new AG, but they couldn’t commit to a firm date.

On Aug. 15, Mr. Phillips and company hastily convened a conference call to say that they still are unable to disclose a release date, but that Naqvi has now met with Reynolds and Vogel, and progress is being made. He did say that processes have to be followed and confidences kept, but mentioned ministerial mandate letters being issued to newly appointed cabinet ministers, suggesting that Naqvi might be receiving such a letter in his new role and that such a letter might contain a reference to the Construction Lien Act Review report and its apparent reference to payment issues in the industry.

ECAO Feedback to the Ministry of Labour (MOL)

ECAO submitted feedback to the MOL last week with regard to mandatory Construction Health and Safety Awareness training. The proposals presented by the MOL:

  • Significantly exceed what the Tony Dean Expert Panel intended in its recommendations;
  • Are impractical and out of step with the times in the manner in which they prescribe training must be delivered;
  • Are too costly as recommended and must be offered through an online format;
  • Disadvantage good performing mainstream companies;
  • Fail to address the willful non-compliers who are responsible for a significant percentage of accidents; and
  • Ignore the need to measure the effectiveness of the training.

Tony Dean Review: Risk of Harm

The Progressive Certified Trades Coalition has published a Risk of Harm report written by Gavin Howe and commissioned by ECAO, IBEW-CCO and the Ontario Pipe Trades Council. Howe’s report, 1,159 Years on the Tools, outlines findings from interviews with 47 electrical and pipe trade experts. We strongly encourage you to read the entire report, and an overview was recently published by the Daily Commercial News.

The Coalition supports the majority of recommendations made in the Tony Dean Review, but some recommendations will cause harm to the trades and the public.

Electrical Safety Authority (ESA) Licence Holder Meetings: October 4 and November 22

ESA has scheduled Licence Holder meetings in October in Kitchener and November in Richmond Hill. There will be an Electrical Industry Expo, updates from ECRA and ESA, an overview of the 9 Standards of Conduct and Qs and As, and a few other topics of interest. Ontario Construction Secretariat (OCS): There’s no such thing as being too safe

In case you missed it, read this article from OCS’s latest newsletter that includes statistics about the “union safety effect.” It also outlines Infrastructure Ontario’s (IO) new mandatory requirement, as of September 1, that all general contractors/constructors have the Certificate of Recognition (COR) to participate in their Request for Qualifications (RFQ) process.

ECAO members have access to the Ground Program, which helps companies update and improve their Occupational Health and Safety management systems and achieve their COR from the IHSA.

Did you know you can access many Ontario collective agreements online? The Collective Bargaining Information Services department of the MOL collects, analyzes and distributes information on collective bargaining relationships in Ontario. Their e-Library Portal includes public and private sector collective agreements.
