Changes to Occupational Health and Safety Act: Sexual Harassment

Bill 132 will take effect on September 8, 2016. Bill 132 expands OHSA’s definition of workplace harassment to include workplace sexual harassment. In addition to being a violation of the Ontario Human Rights Code, it will also be a workplace safety issue.

There are a few items Employers need to address before September 8, including making sure your current workplace harassment and violence policy addresses workplace sexual harassment. There has to be a clear mechanism for employees to make a complaint, a process to investigate those complaints and a duty to provide written results of an investigation. Additional details can be found here: http://www.ontarioemployerlaw.com/2016/07/18/the-deadline-is-fast-approaching-top-5-items-to-prepare-for-bill-132-ohsa-compliance/

Resource material is available on Ministry of Labour’s website, including a draft policy and program. ECAO members have access to a draft policy on the Member’s section of our website.
